The following terms and conditions (these “Terms of Use”) govern your access to and use of the Gemini PR website, including all content, functionality, and services offered on or via www.best-pr-agency.com (the “Website,” by Gemini PR). By using the Website, you accept and agree to be bound and abide by these Terms and Conditions and our Privacy Policy.

Please read these terms and conditions carefully before accessing or using our Website. By accessing or using any part of our Website, you agree to be bound by these terms and conditions. If you do not agree to all of this agreement’s terms and conditions, you may not access the Website or use any Services. If these terms and conditions are deemed an offer, your acceptance is expressly limited to these terms and conditions.

Any new features or tools added to the current store are also subject to the terms and conditions. You can view the most recent version of the terms and conditions at any time on this page. We reserve the right to update, modify or replace any part of these terms and conditions by posting updates and/or changes on our Website. GEMINI PR CO., LTD. is an online platform that provides the following services (Services):

• Provision of contact lists in EXCEL format (the “Contact List(s)”),
• Putting you in touch with public relations, digital marketing, social media and branding experts, and event organiser,
• Completion, directly or through any Service Providers specializing in public relations, digital marketing, social media, branding and event.

Regarding the list of contacts shared by GEMINI PR CO. LTD. and the information they contain, all shared contact information is public, free of rights and freely accessible online on the websites or social networks of the contacts themselves. No personal or protected information is shared out of respect for privacy.

The Service Providers are public relations, digital marketing, social media and branding experts, and event organiser who offer and perform Services proposed on Gemini PR website. Service Providers can be a person providing services directly or an employee of a company who provides services. Please see the section “Service providers” of these Terms of Conditions for more information about Service Providers.

Service providers are not employees or agents of Gemini PR.

Gemini PR is not a party to contracts between users and Service Providers. These contracts are solely between Users and Service Providers. Gemini PR facilitates these contracts by generating a letter of commitment between users and Service Providers and providing communication.

Service providers freely and independently set their prices. Gemini PR will charge Service Providers fees. There is no cost-sharing between Service Providers and Gemini PR.

Purchasers pay for the services provided by the Service Providers and the applicable taxes. Once Service Providers has collected payments, Gemini PR bill their fees to Service Providers.

The prices of our products are subject to change without notice.

We reserve the right to modify or discontinue the Services (or any part or content thereof) at any time without notice.

We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Services.

We reserve the right to refuse any order you place with us. At our sole discretion, we may limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, credit card, and/or orders that use the same billing address. If an order is changed or canceled, we may notify you by contacting the email address provided at the time of order. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by resellers, resellers, or distributors.

You agree to provide current, complete, and accurate purchase and account information for all purchases made in our store. You agree to promptly update your account and other information, including your email address, credit card numbers, and expiration dates so that we can complete your transactions and contact you if necessary.

You may pay for your purchases :

• By credit card. Gemini PR uses the secure payment service provided by OMISE;
• By installments payment as provided by OMISE;
• By internet banking as provided by OMISE;
• By bank transfer. At the time of order, we will provide you with the bank details of the Gemini PR account to which you wish to make the transfer and your file number to be indicated in the transfer order. Orders are processed within a maximum of 48 hours after receipt of the transfer. The order is only considered adequate when the secure banking payment center has given its approval to the transaction.

The payment services of OMISE will not be used in the financial transactions for the payment of Services Providers. In fact, any customer interested in having public relations, digital marketing, social media, branding or event services with the Services Providers of Gemini PR will have to pay these services fees by bank transfer into the bank account of Gemini PR or directly to the Service Providers’ bank account.

However, OMISE payment services will only be used for the payment of contact lists written by Gemini PR, accessible only on the Gemini PR website.

If at our request, you send specific submissions (for example, contest entries) or if, without our request, you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by post, or otherwise (collectively, “Comments”), you agree that we may, at any time and without restriction, edit, copy, publish, distribute, translate and otherwise use the Comments you send to us in any medium. We are not and will not be obligated to (1) keep the Comments confidential, (2) pay compensation for the Comments, or (3) respond to the Comments.

We may, but have no obligation to, monitor, edit or remove any content that we deem, in our sole discretion, to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise objectionable or that violates any party’s intellectual property or these Terms and Conditions.

You agree that your comments do not violate any right of any third party, including copyright, trademark, privacy, personality, or other personal or proprietary rights. You further agree that your comments do not contain defamatory or otherwise unlawful, abusive, or obscene material or contain computer viruses or other malicious software that could in any way affect the operation of the Service or any linked website. You may not use a false email address, pretend to be someone other than yourself, or mislead us or third-parties as to the origin of your comments. You are solely responsible for the comments you make and their accuracy. We assume no responsibility for comments posted by you or any third party.

We want you to be 100% satisfied with our services. If you are not satisfied or if you think there was a billing error, please contact our customer service department by email at gemini@best-pr-agency.com immediately so that we can help you solve the problem, reimburse you or offer you credit that can be used for future services.

When you contact us, please include full details about the services you purchased so that we can ensure that you are completely satisfied with your experience with Gemini PR. All refund requests must be made within 30 days of purchase.

All copyrights, trademarks (including distinctive signs and/or presentation), and other intellectual property rights (registered or not) belong to Gemini PR.

We do not guarantee that your use of our Service will be uninterrupted, timely, secure, or error-free.

We do not warrant that the results obtained from the use of the Service will be accurate or reliable.

You agree that we may discontinue the Service for indefinite periods or cancel the Service at any time without notice from time to time.

You expressly agree that your use or inability to use the Service is at your own risk. The Service and all products and services provided to you through the Service are (unless we expressly state otherwise) supplied to you “as is” and “as available” for your use, without any representations, warranties, or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, fitness for a particular purpose, durability, title, and non-infringement.

In no event shall GEMINI PR CO., LTD., our directors, officers, employees, affiliates, agents, contractors, trainees, suppliers, Service Providers, or licensors be liable for any direct, indirect, incidental, punitive, special or consequential injury, loss, claim or damage of any kind, including, without limitation, lost profits, revenue, savings, data, replacement costs or any other similar damages, whether based in contract, tort (including negligence), any liability, strict or otherwise, arising out of your use of the Services or any product obtained through the use of the Services, or for any other claim relating in any way to your use of the Services or any product, including, without limitation, any error or omission in any content, or any loss or damage of any kind incurred as a result of your use of the Services or any content (or product) posted, transmitted or otherwise made available via the Services, even if advised of the possibility thereof.

Buyers and Service Providers need to resolve disputes between themselves. If for any reason, this fails, users or Service Providers may contact Gemini PR’s customer service department for assistance by email at gemini@best-pr-agency.com.

These Terms and Conditions and any separate agreements whereby we provide you Services shall be governed by and construed following the laws of the Kingdom of Thailand.
